2020 Masterson Station Pool Update

In short, pools have been expressly and impliedly closed since March 17, 2020.
On March 6, 2020, Kentucky Governor Andy Beshear issued Executive Order 2020-215 declaring a state of emergency related to the novel coronavirus (COVID-19) pandemic. On March 17, 2020, the Kentucky Cabinet for Health and Family Services, acting on statutory and delegated authority, ordered the closure of public-facing businesses that cannot observe social distancing, including entertainment, hospitality and recreational facilities, community and recreation centers, gyms and exercise facilities. The classification of a pool would fit into any of the foregoing categories. That executive order delegated authority to local health departments to take “all necessary measures to implement” the order. Further, the order subjects all facilities and businesses to mandatory social distancing requirements. The implication is that any facility or business that cannot strictly comply with CDC social distancing guidelines may not operate.
On April 28, 2020, Gov. Beshear unveiled the Healthy At Work program, which will begin the phased reopening of certain businesses throughout May. As of today, there is no indication when pool operation may be reinstated, or if pools can be reopened in 2020 at all.
As of May 1, 2020, the Lexington-Fayette County Health Department advised that “no pool permits will be issued for any pool, whether publicly or privately owned, until the social distancing orders are lifted.” This closure affects pools owned by homeowners’ associations and condominium associations.
A Facilities and Pool Committee will be held on Tuesday, June 2nd at 7pm to review and recommend next steps as it relates to the 2020 pool season at Masterson Station Neighborhood.
